ARTICLE 2 - DEFINITIONS
Consideration period: the term during which the consumer can make use of their right of withdrawal.
Consumer: the natural person who does not act in the exercise of profession or business and enters into a distance contract with the entrepreneur.
Day: a calendar day.
Sustainable data carrier: any means that enables the consumer or entrepreneur to store information personally addressed to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the consideration period.
Entrepreneur: the natural or legal person who offers products to a consumer at a distance.
Distance contract: a contract in which, within a system for distance sales of products organized by the entrepreneur, use is made exclusively of one or more techniques for distance communication up to and including the conclusion of the contract.
Technique for distance communication: means that can be used for the conclusion of an agreement, without consumer and entrepreneur being together in the same space at the same time.
ARTICLE 3 - APPLICABILITY
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not possible, it will be indicated before the contract is concluded that the terms and conditions can be viewed at the entrepreneur's location and will be sent free of charge as soon as possible at the consumer's request.
If the distance contract is concluded electronically, the text of these terms may be made available electronically in such a way that they can be easily stored on a durable data carrier. If this is not feasible, it will be indicated where the terms can be viewed electronically and that they will be sent free of charge upon request.
In the event of specific product conditions that also apply, these general terms and conditions prevail unless otherwise stated.
ARTICLE 4 - THE OFFER
If an offer has a limited validity or is subject to conditions, this will be explicitly stated in the offer.
The offer includes a complete and accurate description of the products offered. If the entrepreneur uses images, they should reflect the offered products accurately. Obvious errors or mistakes in the offer do not bind the entrepreneur.
The offer provides information about:
The price, including taxes.
Any delivery costs.
How the agreement will be concluded and the necessary actions.
Whether the right of withdrawal applies.
Payment, delivery, and execution methods.
The deadline for accepting the offer.
The period during which the entrepreneur guarantees the price.
ARTICLE 5 - THE AGREEMENT
The agreement is concluded when the consumer accepts the offer and meets the associated conditions.
For electronic acceptance, the entrepreneur will confirm receipt of the offer immediately. The consumer may dissolve the agreement until receipt is confirmed.
The entrepreneur ensures secure electronic transfer of data and employs security measures if the consumer pays electronically.
Upon concluding the agreement, the following details will be provided:
The entrepreneur’s address for complaints.
Conditions for withdrawal or a clear statement of exclusion.
Warranty and after-sales details.
Total cost of products/services, including taxes.
ARTICLE 6 - RIGHT OF WITHDRAWAL
The consumer may dissolve the agreement without reason within seven days after receipt of the product.
The product must be handled with care, kept in its original condition, and returned with clear instructions from the entrepreneur.
ARTICLE 7 - COSTS IN CASE OF WITHDRAWAL
The consumer bears the return shipping costs if exercising their right of withdrawal.
Refunds will be processed within 30 days after the withdrawal or return.
ARTICLE 8 - THE PRICE
Prices will not increase during the validity period, except for VAT changes.
Variable pricing is subject to financial market fluctuations and will be indicated as such in the offer.
ARTICLE 9 - CONFORMITY AND WARRANTY
The entrepreneur guarantees product conformity with the offer. Any warranties do not affect the consumer’s legal rights.
ARTICLE 10 - PAYMENT
Payments can be made via Credit Card, PayPal, Ideal, or Bank Transfer.
Secure payment technology (SSL) is used to protect transactions.
Amounts owed by the consumer must be paid within 14 days unless otherwise agreed.
ARTICLE 11 - DELIVERY AND EXECUTION
Products are delivered to the address provided by the consumer, within 5 days if possible.
If delays occur, the consumer will be notified, and orders may be canceled with a full refund within 30 days.
The risk transfers to the consumer upon delivery.
ARTICLE 12 - COMPLAINTS PROCEDURE
Complaints can be addressed to hello@witlofskincare.com. Complaints will be resolved within 7 working days.
ARTICLE 13 - DISPUTES
Dutch law exclusively governs agreements between the entrepreneur and consumer.
ARTICLE 14 - ADDITIONAL PROVISIONS
Additional provisions may not disadvantage the consumer and must be recorded for accessibility.
ARTICLE 15 - MOBILE SERVICE TERMS
By consenting to Witlof Skincare’s SMS service, you agree to receive messages at your mobile number.
